Woman Won’t Face Charges After Shooting Husband’s Attacker

A Springfield, Massachusetts woman will not face criminal charges after shooting a man earlier this month. Based on the circumstances, prosecutors definitely made the right call in determining that she was acting in defense of others. This is Massachusetts we’re talking about, though, and there’s always a chance that an anti-gun district attorney might decide to make an example out of an armed citizen. 

35-year-old Robert Murchison was shot and killed on July 5. According to Hampden District Attorney Anthony D. Gulluni, Murchison was the initial aggressor in the incident, which was apparently sparked by some sort of dispute on social media. 

Murchison wasn’t content to leave the argument online. Instead, he went to a couple’s home and “initiated a physical altercation with the male homeowner”, according to Gulluni. At one point, Murchison brandished a handgun and started chasing the male homeowner while pointing the pistol at him.  

The homeowner’s wife, who is a licensed firearm owner, witnessed what investigators described as an imminent threat of death or serious bodily injury to her husband and fired a single shot, striking Murchison. Authorities said the homeowners immediately called 911 and fully cooperated with the investigation.

According to the DA’s Office, investigators reviewed statements from those involved, an independent eyewitness account, Ring camera footage, 911 recordings, physical evidence collected at the scene, and text messages and social media communications exchanged before the incident.

Prosecutors said the evidence established that the woman acted in lawful self-defense and defense of another after Murchison came to the home, engaged in a physical confrontation with her husband, and then allegedly threatened him with a firearm.

In a press release, the DA said that after investigating he “determined that his office could not prove beyond a reasonable doubt that the homeowner’s actions were unlawful.” That might be boilerplate language used by his office, but it still strikes me as absurd. 

Of course Gulluni couldn’t prove beyond a reasonable doubt that the woman’s actions were unlawful, because they weren’t. A guy shows up to her home, starts fighting her husband, pulls a gun, and is chasing him while aiming a pistol at him. Is there any doubt that the woman had a reasonable belief that her husband’s life was in danger, and possibly her own as well? 

Gulluni’s press release also states:

That evidence clearly establishes that the female party acted in lawful self-defense and defense of another only after the decedent arrived at her and her husband’s home, engaged in a physical altercation on their property with her husband, and ultimately produced a firearm and posed an immediate threat to her husband.

The DA could and should have stopped there, without adding in the gratuitous statement about not being able to prove that the homeowner’s actions were unlawful. If Gulluni doesn’t believe that a crime was committed, he could just say so and leave it at that. 

If Gulluni isn’t exactly saying the right thing, at least he’s doing the right thing by not charging this woman with any kind of crime. Again, that outcome wasn’t guaranteed. 

Remember the case of Scott Hayes, the gun owner who was charged with shooting a man who ran across the street and tackled him at a pro-Israel demonstration back in 2024? Hayes was charged with assault and battery after he shot his attacker, and it took months before prosecutors finally agreed to a deal that allowed for the charges to be dismissed. 

Thankfully, this woman was spared the nightmare that Hayes went through, but it’s still a sad reality that in Massachusetts, acting in self-defense can still lead to criminal charges if an anti-gun prosecutor decides to make an example out of an armed citizen who defended themselves or others from harm.
